Terms of Use
These Terms of Use ("Terms") apply to the mobile application "Dayzy" (the "App") provided by yoshida works ("we", "us", or "our"). By using the App, you agree to be bound by these Terms. Please read them carefully before using the App.
1. Scope of Application
These Terms govern all relationships between users and yoshida works regarding the use of this App.
2. User Environment
Users are solely responsible for preparing and maintaining the necessary devices, operating systems, network connections, and other environment required to use the App.
3. Prohibited Conduct
Users shall not engage in the following activities:
- Reverse engineering, decompiling, disassembling, or otherwise analyzing the App
- Any behavior that violates laws or public order and morals
- Infringing the rights of our company or third parties
- Redistributing, reselling, or lending the App to others
- Any conduct that we deem inappropriate
4. Intellectual Property Rights
All intellectual property rights related to the App, including but not limited to its design, images, and fonts, belong to us or our licensors.
5. Subscription and Payment
- The main features of the App are available only through a subscription plan:
- USD: $4/month or $24/year
- EUR: €4/month or €24/year
- A 3-day free trial is available with the annual subscription.
- Subscriptions are handled via Apple App Store and Google Play Store. Users must manage cancellations, renewals, and payment methods directly through their respective store accounts.
- Unless canceled at least 24 hours before the end of the current subscription period, the subscription will automatically renew.
6. Use by Minors
If a user is a minor, parental or legal guardian consent must be obtained before subscribing to the App.
- We may, where reasonable, request procedures to verify age or the existence of parental consent.
- If parental consent cannot be verified or legal requirements are not met, we may suspend/terminate use.
- Users under the age of 13 should not provide personal information. Purchases/subscriptions must be made under the supervision of a parent or legal guardian.
7. Disclaimer
- We make no warranties regarding the completeness, accuracy, usefulness, or suitability of the App for a particular purpose.
- We shall not be liable for any damages arising from the use of the App, including but not limited to data loss, device malfunction, or disputes with third parties.
- We are not responsible for the contents of images created, edited, or saved by users using the App.
- The recommended maximum output image size is 2L photo (approximately 127 mm × 178 mm). We do not guarantee resolution or print quality beyond this size. Actual results may vary depending on device, printer, paper, and other conditions.
- To the extent permitted by applicable law, in no event shall our aggregate liability exceed the total fees paid by you to us during the twelve (12) months preceding the event giving rise to the claim (except in cases of our willful misconduct or gross negligence).
8. Privacy and Analytics
- We use Google Analytics to collect anonymous usage data for the purpose of improving the App and analyzing marketing trends.
- We do not collect personally identifiable information such as names or device IDs.
- The use of Google Analytics complies with their privacy policy and applicable laws such as the GDPR. For more information, please refer to Google’s privacy policy.
- Image editing, compositing, and saving are performed on-device. Images are not uploaded to our servers or third-party servers (except when you explicitly choose to share).
9. Modifications, Suspension, and Termination
We reserve the right to modify, suspend, or terminate the App or its services without prior notice.
10. Changes to Terms
We may revise these Terms at our discretion. Continued use of the App following such changes constitutes your acceptance of the revised Terms.
11. Governing Law and Jurisdiction
These Terms shall be governed by the laws of Japan. Any disputes arising in connection with the App shall be subject to the exclusive jurisdiction of the Fukuoka District Court in Japan.
12. Suspension and Termination
We may, at our reasonable discretion, suspend or terminate all or part of the App without prior notice in case of breach (or risk thereof) of these Terms, non-payment, unauthorized access, reverse engineering, involvement with anti-social forces, or where unavoidable for service operation. We shall not be liable for any damages arising therefrom.
13. Refunds, Price Changes, and Taxes
- Prices may be changed without prior notice and will take effect when displayed by us or on the relevant stores.
- Refunds are handled by the app stores (Apple App Store / Google Play). We generally do not provide refunds ourselves unless required by applicable law.
- Whether prices include taxes follows the store display. Exchange rates and fees are subject to each platform’s conditions.
14. Anti-Social Forces
Users represent and warrant that they are not, and will not become, members of anti-social forces. We may terminate the agreement immediately without notice upon any breach.
15. Assignment and Business Succession
We may assign or transfer our status, rights, and obligations under these Terms in connection with business transfers, corporate splits, mergers, or similar transactions. Users may not assign without our prior written consent.
16. Indemnification
You shall indemnify and hold us harmless from and against any losses, damages, and costs (including reasonable attorneys’ fees) arising out of your breach of these Terms or use of the App.
17. Severability and No Waiver
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right shall not be deemed a waiver.

19. Language
These Terms are prepared in Japanese and may be provided in other languages for reference. In the event of any inconsistency or conflict, the Japanese version shall prevail.
